PRIVACY POLICY

PROTECTION OF PERSONAL DATA

The purpose of this Privacy Policy is to inform you for what purposes your personal data will be collected, how it will be used and what are your rights in relation to the data we hold about you and how to exercise them. This Privacy Policy regulates the collection, storage and processing of personal data that LabelProfi d.o.o. collects from you when you use the website http://www.labelprofi.si/, the LabelProfi online store and related web pages placed by the operator on this website.

LabelProfi d.o.o. respects your privacy and undertakes to process personal data obtained via the online information system of LabelProfi d.o.o. or the LabelProfi online store in accordance with the applicable European legislation (General Data Protection Regulation) and in accordance with the national legislation of the Republic of Slovenia (Personal Data Protection Act, Electronic Communications Act, Electronic Commerce Market Act).

LabelProfi d.o.o. undertakes to protect all personal data obtained with due diligence and not forward them to any third party or use them for any other purpose whatsoever without your consent. Since there are certain links in the LabelProfi d.o.o. online information system to other external websites that are not directly related to our company, we do not assume any responsibility for the data protection on these websites.

User: A website user is any person who uses the website or online store as a visitor.

PERSONAL DATA: COLLECTION, PROCESSING AND PURPOSE FOR WHICH PERSONAL DATA ARE PROCESSED

Personal data is any information that identifies you as an identified or identifiable individual. An individual is an identifiable person if they can be identified either directly or indirectly, particularly by specifying an identifier such as a name, an identification number, location data, a web identifier, or by indicating one or more factors characteristic of the physical, physiological, genetic, mental, economic, cultural or social identity of that individual.

In accordance with the purposes specified below, the Controller collects and processes the following personal data:

  • contact data and data on your communication with the Controller (name and surname, company, e-mail address, telephone number, date, time and content of postal or electronic communication);
  • data on the users of the Controller's website (IP address, dates, hours and duration of visits to the website, data on location or internet access entry points, data on subpages visited, data on settings made, etc.);
  • data on registered users (e-mail address, password and other data and purchases);
  • data about registered buyers of products (entries in the shopping cart, name and surname, residence address, e-mail address, telephone number, address for delivery of products, contact information for delivery and telephone number, method of collection and delivery of products, method of payment);
  • data on the user's purchases and issued invoices (date and place of purchase, purchased products, prices of purchased products, total amount of purchase, method of payment, delivery address, number and date of issue of the invoice, code of the person who issued the invoice, etc.) and information on resolving product complaints;
  • data on entries in online forms (e.g. e-list subscription or type or area of interest for receiving advertising messages);
  • other data that users voluntarily provide to the Controller when ordering a particular product or submitting an offer or demand.

The Controller does not collect or process your personal data, except with your permission or consent, i.e. when ordering products, when you subscribe to receive notifications via our e-list or when there is a legal basis for collecting personal data or we have legitimate interests in processing your data.

Any personal data you provide to us will be treated confidentially and will only be used for the purposes for which it was provided and collected. If there is a need for further processing of your data for any other purpose, we will contact you in advance and ask for your prior written consent.

The Controller assumes no responsibility for the authenticity, accuracy and timeliness of personal data and contact data provided by the user. As a user of the website, you are obliged to ensure the accuracy and timeliness of all data provided via the website.

The website may also automatically collect some information about the hardware and software of the user's computer. Personal data (IP address) obtained on the basis of a visit to the website is not stored or is stored in an anonymized form and as such is not directly linked to users. This information will be used exclusively to produce general statistics on the use of the website. This data is collected using cookies. The use, management and deletion of cookies is described in more detail below.

VISIT TO THE LABELPROFI ONLINE STORE

Every time you visit our website a web server log file is automatically stored on the web server. We collect the (personal) data collected in this way with the help of cookies, whereby we will ask for your consent before installing more invasive cookies, while we may also collect certain other data based on our legitimate interests.

We process the (personal) data collected in this way separately and do not associate it with other personal data of users of our websites and do not use any profiling of your purchasing behaviour.

MAKING A PURCHASE OF PRODUCTS

We process your personal data in particular if you purchase certain products as a registered user of our online store. We process this data exclusively for the purposes of fulfilling our contractual obligations and enforcing the rights from the contractual relationship, including resolving product complaints.

Personal data provided for the purpose of delivering the products are processed exclusively for the purpose of delivering the products to your address. Such personal data (e.g. name and surname, delivery address, telephone number) may be forwarded to the providers of transport of goods.

Additionally, we may also use your contact details to communicate with you in relation to the performance of the contract and to send inquiries about your satisfaction, in accordance with our legitimate interests.

Based on the Electronic Communications Act, we can inform our customers about our products and contents using their e-mail addresses. We do not use any (automatic) profiling for this purpose but only send basic customized messages that we believe may be of interest to you based on your past interactions with us. You can object to the processing of your contact data for the purpose of such direct advertising at any time by sending us an e-mail to: info@labelprofi.com. SENDING ENQUIRIES AND OTHER COMMUNICATION WITH US

When you send us a demand for a specific product using our contact details (address, e-mail address, telephone number) published on our website, we process your personal data exclusively for the purpose of responding to your request and informing you whether the requested product is available, for the possible drafting and conclusion of a contract, for the performance of the concluded contract and to answer your question.

For this purpose, we collect only your personal data that you provide to us on a voluntary basis. All data collected through our websites or otherwise communicated to us (e.g. via telecommunication means) is collected for the purpose of providing the services of an online store and for the purpose of our internal administration and management of our business operation.

Based on our legitimate interest, we may also process the provided contact information for basic personalized communication with you via e-mail where we will try to present to you relevant products that may be of interest to you based on your past interactions with us. For this purpose we do not use any (automatic) profiling, but only select appropriate sets of recipients for individual messages. DATA USERS

We undertake not to transfer your personal data to third unauthorised parties without your consent.

We inform you that we may outsource individual tasks related to your data to our business partners (contractual processors). Contractual processors may process the entrusted data exclusively on our behalf and within the limits of our authorization (based on a written contract or other legal act) and in accordance with the purposes set out in this Document. The data provided are carefully protected and not kept in stock by these partners and are not used for their own purposes.

Within the scope of legal competence, your personal data may be disclosed to the following data users:

-        postal service providers, shipping service providers and logistics/delivery services for the purpose of executing your order;

-        distributors, goods suppliers and authorised repairers;

-        accounting services, law firms and other providers of legal and business consultancy;

-        providers of file and data carrier destruction services;

-        information technology service providers in the framework of servicing and maintenance of software;

-        website administrator and trustee;

-        cloud computing services providers and providers of e-mail sending (e.g. SqualoMail and others);

-        providers of customer relationship management systems.

We undertake that neither us nor other users will forward or transfer your personal data to a third country outside the European Union and/or the European Economic Area or to an international organization without an appropriate level of protection. Your personal data may be transferred to the USA, whereby all our contractual processors in the USA are included in the EU-US Privacy Shield programme or, in the event of data transfer, provide other appropriate safeguards in accordance with the provision of Article 46 of the General Data Protection Regulation (e.g. acceptance of Standard Contractual Clauses).

PERSONAL DATA RETENTION PERIOD

Data collected by the website operator is stored for the needs of the website operator in accordance with the terms and purposes set out in this Privacy Policy. Personal data is stored on the website  and in case of further processing and communication with the user also in other company databases (CRM, software for merchandise management).

Personal data retention period may vary depending on the applicable legislation (e.g. legislation in the field of taxes, accounting). If the applicable sectoral legislation specifies mandatory periods for the storage of personal data, LABELPROFI d.o.o. deletes personal data after the expiration of the mandatory period prescribed by law.

The user can request access to their personal data or data on the processing of their personal data by the authorized persons by sending a written request to the address LabelProfi d.o.o., Ozare 18a, 2380 Slovenj Gradec, Slovenia, or to the e-mail address: info@labelprofi.com. We will process and respond to your application in accordance with the GDPR.

SECURITY OF YOUR DATA

We carefully protect the data that you provide to us through the use of our websites, via telecommunication channels or in any other way, against loss, misuse, unauthorized access or disclosure, alteration or destruction.

The data is stored on password-protected servers with limited access. The online store ensures the safety of your personal data and respects your choices for their intended use.

After the termination of the need to keep data, i.e. after the fulfilment of the purpose for which the data was collected, the data is immediately irreversibly and permanently deleted.

In cases when links to other websites are published in the online store, that have no connection with the Controller, we do not assume any responsibility for the protection of your data on these websites.

FREEDOM OF CHOICE

The information you provide to us is controlled by you. If you decide not to provide us certain information, then you will not have access to certain sites or functions on our website, and in such cases we will not be able to respond to your request or enter into a contractual relationship with you and consequently sell and deliver the desired products to you.

CONSENT GIVEN BY CHILDREN

Children under the age of 15 may provide us with personal data through our websites or otherwise only with the permission (consent or approval) of the holder of parental responsibility in relation to the child (one of the parents or guardians).

We undertake that we will never knowingly collect personal data from persons we know are under the age of 15. We will not use or disclose this information to any third party without the permission of the holder of parental responsibility in relation to the child. The above does not affect the rules of the Slovenian contract law regarding the rules on the validity, formation or effect of a contract in relation to a child.

In such cases, the controller will make reasonable efforts to verify, taking into account the available technology, whether the holder of parental responsibility in relation to the child has given their consent or approval.

YOUR RIGHTS

LabelProfi d.o.o. guarantees the exercise of all your rights in relation to the processing of your personal data on the basis of applicable legal regulations.

As individuals, you have the following rights:

Right to withdraw consent: If you, as an individual, have given your consent to the processing of your personal data (for one or more specific purposes), you have the right to withdraw your consent. Withdrawal of consent does not affect the lawfulness of data processing that was carried out prior to the withdrawal.

You can withdraw your consent at any time free of charge by sending a written statement to the controller using the e-mail address: info@labelprofi.com. The withdrawal of consent to the processing of your personal data leads to no negative consequences or sanctions.

Right of access to personal data: As a data subject, you have the right to obtain confirmation from the controller as to whether or not personal data concerning you are being processed. If this is the case, you have the right to get access to your personal data (i.e. access, transcription or copying) and to be provided with information regarding the processing of your personal data (e.g. about the purpose of the processing, the type of personal data, the users to whom the personal data have been or will be transmitted, the envisaged period of data retention, technical and organizational measures for data protection, the existence of automated decision-making, including profiling, etc.),

Right to rectification: As an individual, you have the right to obtain the rectification of inaccurate personal data relating to you and supplementation of incomplete personal data. For this purpose, you have the right to provide us with a supplementary statement with up-to-date personal data.

Right to the erasure of personal data (the right to be forgotten): You have the right to have the personal data relating to you deleted by the Controller without undue delay, if one of the situations from Article 17 of the General Data Protection Regulation applies (e.g. if the data is no longer necessary for the purposes for which it was collected or otherwise processed, if you withdraw your consent and there is no other legal basis for processing, if you object the processing and there are no overriding legitimate interests, if the personal data was processed illegally, etc.).

Right to restriction of processing: You have the right to have the processing of your data restricted by the Controller if one of the following cases applies:

-        if the accuracy of the personal data is contested, for a period that allows the Controller to check the accuracy of the data;

-        if the processing is unlawful and you oppose the erasure of the personal data and request the restriction of its processing;

-        if the Controller no longer needs the personal data, but they are required by you for the establishment, exercise or defence of legal claims;

-        if you have objected the processing, pending the verification whether the legitimate interests of the Controller override your reasons.

Right to data portability: As an individual, you have the right to receive your personal data in a commonly used and machine-readable format and to have this data directly transmitted to another controller, whereas this only applies if the processing of your personal data is based on your consent or contractual relationship and the processing is carried out using automated means.

Right to object: If the processing is based on our legitimate interests, you have the right, on grounds relating to your particular situation, to object at any time to the processing of your personal data. In this case, we will only continue to process your personal data if we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or for the establishment, exercise or defence of legal claims.

You can object to the processing of your personal data for direct marketing purposes, including profiling, at any time and free of charge, without stating any reason, by writing to us at: info@labelprofi.com. Where you object to processing of your data for direct marketing purposes, we will immediately stop processing your data for these purposes.

In accordance with the applicable law, we will also provide you, at your request, with other information related to your personal data processed by us.

LabelProfi d.o.o. will ensure the accuracy and currency of the data on the website with all due diligence, however the company assumes no responsibility for the currency and integrity of the data nor for any damage resulting from this. LabelProfi d.o.o. also assumes no liability in relation to the consequences caused by the information contained on this website. LabelProfi d.o.o. assumes no responsibility for any viruses that may be transmitted to users from this website, and recommends that users have adequate anti-virus protection prior to downloading information from this website.

LabelProfi d.o.o. is not responsible for occasional non-functioning of the website, possible inaccuracy of information or possible damage caused by the use of inaccurate or incomplete information. LabelProfi d.o.o. or any other legal or natural person who participated in the creation and making of these websites is therefore not liable for any damage arising from access to, use or inability to use the information on these websites or for any errors or omissions in their content.
